मप्र हाईकोर्ट ने प्रमोशन में SC/ST रिजर्वेशन खत्म किया

जबलपुर 30 अप्रैल(इ खबरटुडे)| ‘शनिवार को एक ऐतिहासिक फैसले में मध्यप्रदेश हाईकोर्ट ने प्रदेश सरकार के विभिन्न विभागों में प्रमोशन में SC/ST को दिये जा रहे रिजर्वेशन को अवैध करार दिया है। मुख्य न्यायधीश अजय माणिकराव खानविलकर की प्रिंसपल बेंच ने अपने ऐतिहासिक फैसले में कहा है कि SC/ST को सिर्फ नियुक्तियों में दिये जाने वाला आरक्षण ही वैध माना जाएगा।

चीफ जस्टिस खानविलकर ने हाईकोर्ट ने अपने विस्तृत फैसले में साफ किया कि नियुक्तियों के दौरान समाज के वंचित वर्ग को नियमानुसार आरक्षण मिलना तार्किक है, लेकिन पदोन्नतियों में आरक्षण दिए जाने से वास्तविक योग्यताओं में कुंठा घर कर जाती है। पदोन्नति प्रक्रिया में अनुसूचित जनजाति, अनुसूचित जाति और अन्य पिछड़ा वर्ग को विशेष वरीयता और सामान्य वर्ग को पीछे रखना ठीक नहीं। इसीलिए पदोन्नति में रिजर्वेशन किसी भी कोण से न्यायोचित नहीं माना जा सकता। हाईकोर्ट ने यह निर्णय कई पीड़ित सरकारी कर्मचारियों की विभिन्न याचिकाओं पर कई सालों तक चली लंबी बहस के बाद दिया है। गौरतलब है कि कई प्रदेश सरकारों में हाईकोर्ट के निर्णयों के बाद से प्रमोशन में एसी-एसटी रिजर्वेशन खत्म करने की व्यवस्था लागू है। फैसले के खिलाफ राज्य सरकार सुप्रीम कोर्ट में कर सकती है अपील जबलपुर हाईकोर्ट ने एक याचिका की सुनवाई में आज फैसला देते हुए सरकारी नौकरियों में पदौन्नति के समय आरक्षण के लाभ देने को अवैध ठहराया है। हाईकोर्ट के फैसले का अध्ययन कर रही है राज्य सरकार । सूत्रों का कहना है कि राज्य सरकार हाईकोर्ट के इस फैसले के खिलाफ सुप्रीम कोर्ट में अपील करने का विचार कर रही है । अफसरों के द्वारा इस मामले में कानूनी सलाह ली जा रही है। यहां बता दें कि मप्र हाईकोर्ट ने 30 अप्रैल,2016 प्रमोशन में रिजर्वेशन यानि भर्ती के बाद पदोन्नति में भी एससी और एसटी को आरक्षण का लाभ देकर अलग से प्रमोशन देने वाले 2002 के सौ बिन्दू के रोस्टर और सर्कुलर को पूरी तरह से खारिज करके नल एंड वाइड घोषित कर दिया है। इससे सामान्य, पिछड़ा वर्ग और मुसलमान सरकारी कर्मचारी और अधिकारी भी प्रमोशन में बराबरी पर आ जाएंगे। हालांकि बीते 13 साल से संविधान विरोधी प्रमोशन लेकर ऊपर पहुंचे आरक्षित वर्गों के अधिकारियों कर्मचारियों का डिमोशन भी तत्काल होगा या फिर मप्र भाजपा सरकार इसमें टाल मटोल करेगी? उल्‍लेखनीय है कि उत्तर प्रदेश में 5 सितंबर,2015 को दो लाख कर्मचारी अधिकारी डिमोट कर दिए गए हैं। बिहार और राजस्थान में भी हो चुका है। अब बारी है मप्र की है, जहां एससी एसटी को मिले गलत प्रमोशन को खत्म करके डिमोशन किया जाकर सामान्य, मुस्लिम और पिछडे वर्ग के साथ न्याय किया जाए। क्या भाजपा और शिवराज सरकार ऐसा करेगी?

Brief summary of the controversy is as under:

The division bench of Hon’ble Shri AM Khanwilkar CJ and Shri Sanjay Yadav J, has quashed the relevant provisions of the MP Public Service promotion Rules, 2002, which related to provisions of reservation for SC and STs in all classes of all posts of various government departments. The main basis for challenge was that the Rules are not in conformity with he guidelines given by the Hon’ble Supreme Court in the case of M. Nagraj Vs. Union of India delivered in 2006. In the said judgment the Apex Court had laid down certain guidelines while interpreting Articles 16, 16(4), 16(4A), 16(4B) and 335 before making provisions of reservations in promotion with benefit of consequential seniority, filling up of backlog vacancies, lowering of standards of evaluation etc. The court had further required the Government to satisfy itself after collection of ‘quantifiable’ data in each case to ensure that there is no reverse discrimination vis-a-vis the General category candidates. During the arguments it was urged by the petitioners that the Rules are ultra vires as no exercise to collect quantifiable data as directed by the Supreme Court was done by the State Governments before framing such rules and such the operation of these Rules was resulting in reverse discrimination in various departments. It was further submitted that the Rules are ultra vires also because the other directions as mandated by the Apex Court have also not been followed. The arguments stretched through three days from 29.03.2016 to 31.03.2016 and the judgment was reserved on 31.03.2016. On 30.04.2016 the judgment was pronounced in open court whereby the Hon’ble Court has quashed the Rules as ultra vires and unconstitutional and has further held that any promotions made on the basis of Rules of 2002 are unconstitutional. The implication of this judgment will be that all the promotions made under the Rules of 2002 are non est in the eyes of law and will be reverted and the gradation lists of various departments will have to be redrawn as prior to the enactment of Rules of 2002. The matter was argued by Shri R. N. Singh Sr. Advocate and Amol Shrivastava and Suyash Guru Adocates for the petitioners. Additional AG appeared on behalf of the State, Sr Advocate Naman Nagrath appeared on behalf of AJAX.
